Terms and Conditions

These terms and conditions (“Terms”) outline the agreement between Ancestral Journeys (“Genealogist,” “we,” “us,” or “our”) and the client (“Client,” “you,” or “your”) in relation to the genealogy research services provided by the Genealogist. By engaging our services, you agree to adhere to these Terms. Please read these Terms carefully before proceeding.

  1. Services Provided: The Genealogist agrees to provide genealogy research services as requested by the Client. These services may include but are not limited to ancestral research, family tree creation, historical documentation retrieval, and consultation.
  2. Client’s Responsibilities: The Client shall provide accurate and complete information about their genealogical research needs, family history, and relevant documents. The Client also agrees to promptly respond to inquiries and provide necessary clarifications throughout the research process.
  3. Research Process: The Genealogist will perform research based on available information and documents. However, due to limitations in historical records and data availability, the Genealogist cannot guarantee the discovery of specific ancestors or details.
  4. Payment: The Client agrees to pay the agreed-upon fees for the genealogy research services as outlined in the service proposal or agreement. Payment details, including rates and deadlines, will be provided in writing prior to engagement.
  5. Intellectual Property: Any research findings, reports, family trees, and related materials produced by the Genealogist are the intellectual property of the Genealogist. The Client is granted a non-exclusive, non-transferable license to use these materials for personal and non-commercial purposes only.
  6. Confidentiality: The Genealogist will treat all information provided by the Client as confidential and will not share or disclose such information to third parties without the Client’s explicit consent, except where required by law.
  7. Limitation of Liability: The Genealogist shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the genealogy research services provided. The liability of the Genealogist shall be limited to the fees paid by the Client for the specific research services.
  8. Termination: Either party may terminate the engagement by providing written notice. The Client shall be responsible for any fees related to work completed up to the date of termination.
  9. Governing Law: These Terms shall be under the jurisdiction of and interpreted in accordance with the legal system of England and Wales, without consideration for its conflict of laws principles.
  10. Changes to Terms: The Genealogist reserves the right to modify or update these Terms at any time. Clients will be notified of any changes, and continued use of services after modifications constitutes acceptance of the revised Terms.
